1. Introduction
Lyven is run by Lyven Ltd, a company registered in England and Wales under number 13777526 with its registered office at Silverstream House 4th Floor, 45 Fitzroy Street, Fitzrovia, London, W1T 6EB. In these terms, "Lyven", "we", "us" and "our" mean Lyven Ltd. "You" means the person using Lyven.
Lyven helps you find live music events near you, see who else is going, and connect with them. You can build a profile, post and comment, send private messages, and save or join events. The app, our website at lyven.app, and everything that goes with them are "the Services".
These terms, together with our privacy notice at lyven.app/privacy, are the agreement between you and us. By creating an account or using the Services, you accept them. If you do not agree with them, do not use Lyven.
1a. Changes to these terms
We will change these terms from time to time, for example when we add a feature or the law changes. If a change matters to you, we will tell you in the app or by email at least 30 days before it takes effect, and the date at the top of this page will change. Smaller changes, such as corrections or clearer wording, take effect when we publish them. If you do not accept a change, you can delete your account before it takes effect. If you keep using Lyven after that date, the new terms apply.
2. Who can use Lyven, and your responsibilities
2a. Who can use Lyven
You can create an account only if all the following are true:
- You are at least 18 years old. We ask for your date of birth when you sign up, and we refuse anyone under 18.
- You live in the United Kingdom.
- You are a person, not a business or organisation, and you are signing up for yourself.
- You have not been banned from Lyven before.
- You do not already have a Lyven account. One person, one account.
If any of these stops being true, you must stop using Lyven, and we may close your account.
2b. Your responsibilities
When you use Lyven, you agree to:
- Give us accurate information about yourself and keep it up to date.
- Keep your sign-in details safe. You are responsible for everything that happens on your account, so tell us at support@lyven.app straight away if you think someone else has got into it.
- Follow the community guidelines in section 2d, and treat other members with respect, in the app and when you meet them.
- Use the app as we provide it and keep it up to date.
2c. Things you must not do
You must not:
- Pretend to be someone else or lie about your age or who you are.
- Use someone else's account or let anyone else use yours.
- Create a new account after we have banned you or help someone else do so.
- Make reports you know to be false or use the reporting tools to harass someone.
- Collect other members' information, by hand or with software, or use anything you learn on Lyven to harass, stalk or harm someone.
- Use Lyven to advertise, sell anything, run competitions or promotions, or send spam.
- Use bots, scripts, or other automated tools to access Lyven, or try to get around the security of the app or our systems.
- Copy, change, take apart or reverse engineer the app, or build something that competes with it using our Services or content.
- Interfere with the Services, or with other members' use of them.
- Use Lyven for anything illegal.
2d. Community guidelines: content you must not post
These guidelines apply to everything you post or send on Lyven: your profile, including your photos, name, username and bio; posts and comments; and private messages. Do not post or send anything that:
- Is illegal or encourages or helps anyone to break the law. This includes terrorism content, content that sexualises or exploits children, intimate images shared without the consent of the person in them, threats, incitement to violence, fraud, and offers to buy or sell drugs or weapons.
- Attacks or demeans people because of their race, ethnicity, nationality, religion, disability, sex, sexual orientation, gender identity or age.
- Harasses, bullies, threatens, intimidates or humiliates anyone.
- Is sexually explicit or shows nudity.
- Shows or glorifies violence.
- Promotes or encourages suicide, self-harm, or eating disorders.
- Shares someone's private information, such as their address, phone number or photos of them, without their permission.
- Is spam or is repetitive or deliberately disruptive.
- Is not yours to post, because it infringes someone else's copyright or other rights.
- Contains viruses or other malicious code.
Section 4 explains how we find content that breaks these guidelines and what we do about it.
3. Content
3a. Your content
"Your Content" is everything you put on Lyven: your profile and photos, your posts and comments, and your messages. You own it, and you are responsible for it. By posting it, you confirm that it is yours or that you have permission to post it, that it does not break the community guidelines, and that it is accurate where it describes you.
Your profile, posts and comments can be seen by other members. If you share a link to your profile, anyone with the link can see a preview showing your display name, username and photo, whether or not they have an account. Think before you share personal information, because once other people have it we cannot take it back.
Section 7 describes what we can do with Your Content.
3b. Other members' content
You can look at other members' content as part of using Lyven. You must not copy it, save it, or share it outside Lyven without their permission, and you must never use it to harass, stalk or harm them. Breaking this rule can lead to your account being closed.
3c. Our content and event listings
Everything else in the Services, including the app, its design, our name and logo, and the text and graphics we write, belongs to us or to our licensors. You may use it only as part of using Lyven.
Event listings on Lyven come from Ticketmaster. We show them as we receive them. We do not promise that a listing is accurate or complete, or that an event will go ahead, and we do not sell tickets. Any ticket you buy is a contract between you and the seller, under their terms. If you spot a listing that is wrong, you can flag it in the app.
3d. Copyright complaints
If you believe something on Lyven infringes your copyright, email support@lyven.app with a link to the content, a description of the work you own, and your contact details. We will look into it and remove the content if we agree.
4. Harmful content and behaviour: how we deal with it, how to report it, and how to appeal
4a. How we protect you from illegal and harmful content
We use a combination of automated tools and human review to find content that breaks the community guidelines or the law:
- Posts, comments, profile photos, names, usernames and bios are checked automatically when you publish them, using automated content-screening tools provided by a third party named in our privacy notice.
- Private messages are not checked automatically. They are not end-to-end encrypted, so we can read them, but we only do so when a message or the person who sent it is reported and a member of our team needs to investigate it.
- A post or comment that the tools flag is hidden straight away, and you are told. A member of our team then looks at it and either restores it or removes it.
- A profile photo that the tools flag is removed straight away, and you are told. There is no review, and you can upload another.
- A name, username or bio that the tools flag is refused on the spot, so it is never published. You can change it and try again.
- Reports from other members are reviewed by a member of our team, who decides what to do.
The automated tools are not perfect. They can miss things, and they can flag things that are fine. That is why a person reviews flagged posts and comments, and why you can appeal under section 4d.
Terrorism content and content that sexualises or exploits children are the most serious. We remove them as soon as we become aware of them, we permanently ban the account, and we report them to the appropriate authorities. Other illegal content, such as threats, harassment, intimate images shared without consent, fraud, and offers of drugs or weapons, is removed when we find it, and the account is dealt with under section 4b. We prioritise reports about intimate images shared without consent.
4b. What happens when the guidelines are broken
What we do depends on how serious the problem is and whether it has happened before. It ranges from removing the content and warning you, to permanently banning your account. Content that is clearly illegal, or that is seriously harmful, leads to a ban.
A ban is permanent. It deletes your account, and it blocks the email address and devices the account used from signing up again. If other accounts have signed in on the same devices, they are closed too. A new account made on a banned device is deleted automatically.
We will tell you when we remove your content or ban your account. We may not tell you the reason, or who reported you, if doing so could put another person's safety or privacy at risk.
4c. How to report content or a member
If you see something that breaks the community guidelines, report it. On any post, comment, message or profile, open the menu and choose Report, then choose the category that fits best and tell us anything else we should know. You can also block a member, which stops them seeing your profile and content and stops you seeing theirs.
If you cannot report from the app, for example because you no longer have an account, email support@lyven.app.
Every report is looked at by a member of our team. We will not tell the person you reported who reported them. We do not currently tell you what we decided.
Reports that you know to be false, or that are made to harass someone, break these terms. Repeatedly making them can lead to your account being banned.
4d. Complaints and appeals
If we have removed your content or banned your account and you think we got it wrong, you can appeal. Email support@lyven.app with "Appeal" in the subject line, tell us what was removed or that your account was banned, and explain why you think the decision was wrong. You can appeal even if you no longer have an account.
We will review the decision again, taking into account anything you tell us, and reply by email with the outcome. If we agree with you, we will restore your content or your account where we can. Some things cannot be restored, such as a profile photo that has been removed.
You can also use the same address to complain about anything else in this section, including if you think we have failed to act on a report, or if you think we are applying the community guidelines unfairly.
If you believe we have acted against your content or your account in a way that does not follow these terms, you have the right to bring a claim against us for breach of contract. We encourage you to appeal first, because that is usually quicker.
5. Privacy
Our privacy notice at lyven.app/privacy explains what personal information we collect, why, who we share it with, how long we keep it, and your rights. It also explains what is kept after you delete your account. For anything about your personal information, email privacy@lyven.app.
6. What you can do with Lyven
We give you a personal, non-transferable licence to install the app on devices you own or control and to use the Services for your own, non-commercial use, as long as you follow these terms. We can end this licence if you break them. Everything we do not expressly allow is reserved to us.
If you downloaded the app from the Apple App Store or Google Play, their terms also apply to the download, and they are not responsible for the app or for supporting it. We are.
7. What we can do with what you post
Your Content stays yours. To run Lyven, we need your permission to handle it, so you give us a non-exclusive, worldwide, royalty-free licence to host, store, copy, display, reproduce and adapt Your Content, for example by resizing a photo, showing a preview of a post in a notification, or including it in search results. We use this licence to operate, improve and protect the Services, and to promote Lyven, for example by quoting a post in our own marketing. We will not show your name, username or a photo of you in our marketing without asking you first. If you delete a post or your account, we will stop using it in new marketing.
The licence ends when you delete the content or your account, except that:
- Copies that other people have already received, such as a notification or a link preview, may remain on their devices.
- Private messages stay visible to the other person in the chat until they also delete their account.
- For 30 days after you delete your account, we keep a locked copy of what other people could see, so that we can investigate harmful behaviour and answer lawful requests. If we banned your account, we keep that copy for one year, because the law requires us to keep content we have reported to the authorities and because requests about a banned account often come months later. Nothing in the app can read it.
- Content we removed for breaking the community guidelines, and reports about it, are kept for 12 months.
- Deleted content can stay in our backups for up to 7 days.
Our privacy notice describes each of these in more detail.
8. Ending your account
8a. Deleting your account
You can delete your account in the app at any time, from Settings. Deletion removes your profile, photos, posts, comments and connections, and frees your username. What is kept afterwards, and for how long, is described in section 7 and in our privacy notice.
8b. When we can end it
We can suspend, close or ban your account if you break these terms, if we are required to by law, or if we stop providing Lyven. Section 4 describes what a ban means. If we close your account for a reason other than a breach of these terms, we will give you reasonable notice where we can.
Whichever of us ends it, the parts of these terms that are meant to continue do so: sections 3, 7, 11, 12 and 13.
9. We don't vet members
We do not run identity or criminal record checks on members, and we cannot confirm that anyone is who they say they are. You are responsible for your own interactions with other members. Private messages are stored securely but are not end-to-end encrypted, so do not share anything in a message that you would not want anyone else to see.
If you arrange to meet someone from Lyven, meet in a public place, tell a friend where you are going, and keep hold of your own travel and tickets. Our safety guidance at lyven.app/staying-safe has more. If someone makes you uncomfortable, block them and report them.
10. Availability of the service
Lyven is free to use. We will provide it with reasonable care and skill, but we cannot promise that it will always be available or free of faults. We may need to take it offline for maintenance, and things outside our control, such as a problem at a provider we rely on, can interrupt it.
We may change or withdraw features, or stop providing Lyven altogether. If we stop, we will give you reasonable notice where we can, so that you can save anything you want to keep.
11. Our responsibility to you
We are responsible to you for loss or damage that we cause by breaking these terms or by failing to use reasonable care and skill, where that loss was foreseeable when you accepted these terms. We are not responsible for loss that was not foreseeable, or for business losses, since Lyven is for personal use.
We are not responsible for:
- What other members post, say or do, on Lyven or when you meet them. Section 9 explains why.
- Event listings being wrong, or events being changed or cancelled. Section 3c explains where they come from.
- Tickets or anything else you buy from a third party.
- Loss or damage caused by something outside our reasonable control.
Nothing in these terms limits or excludes our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit or exclude. Nothing in these terms affects your legal rights as a consumer.
12. Governing law and where to bring a claim
These terms are governed by the law of England and Wales. You can bring a claim about them in the courts of England and Wales. If you live in Scotland you can also bring a claim in the Scottish courts, and if you live in Northern Ireland you can also bring a claim in the courts of Northern Ireland.
If you have a complaint, please contact us first at support@lyven.app and give us the chance to put it right.
13. The whole agreement
These terms and our privacy notice are the whole agreement between you and us about the Services. If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce a part of these terms straight away, we can still enforce it later. We may transfer our rights and obligations under these terms to another organisation, and we will tell you if we do. You may not transfer yours, since your account is personal to you.
